Agreement and eligibility

These Terms of Service (“Terms”) are an agreement between you and the operator of MackAI (“MackAI,” “we,” “us,” or “our”). They govern your access to mackai.app, MackAI Today, the Full Terminal, and related features, content, communications, and services (collectively, the “Service”).

By creating an account, purchasing a plan, or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind it. You must be at least 18 years old and legally able to enter into this agreement.

What MackAI provides

MackAI is investment research and portfolio-intelligence software for individual investors. Depending on your access level, the Service may provide a daily portfolio plan, market and evidence briefings, portfolio analytics, watch plans, alerts, ticker research, thesis monitoring, comparative analysis, discovery tools, AI conversations, decision records, and advanced research workflows.

Some outputs are generated automatically from your portfolio context, preferences, saved plans, market data, third-party sources, and AI models. Features may be identified as beta, preview, experimental, or invite-only and may change as the product develops.

Research software, not financial advice

MackAI does not provide personalized financial, investment, tax, accounting, or legal advice. It is not a registered investment adviser, broker-dealer, exchange, custodian, bank, or fiduciary, and it does not manage assets or execute trades.

Scores, ratings, rankings, alerts, price targets, sizing illustrations, portfolio observations, “Next Dollar” outputs, and AI-generated language are informational research tools—not instructions or recommendations to buy, sell, hold, or allocate capital. You remain solely responsible for verifying information and deciding whether any action fits your circumstances. Consider consulting qualified professionals before acting.

Investment and market risk

Investing involves risk, including the possible loss of some or all invested capital. Markets can move before data, alerts, or analysis update. Historical performance, backtests, simulated outcomes, confidence scores, and model-generated scenarios do not guarantee future results.

You are responsible for your investment decisions, order review, position sizing, liquidity needs, tax consequences, and compliance obligations. Never rely on the Service as your only source of information or as an emergency risk-control system.

AI and data limitations

The Service combines third-party market data, public-source research, deterministic calculations, and generative AI. Any of these inputs can be delayed, incomplete, misclassified, unavailable, or wrong. AI output may contain factual errors, unsupported inferences, outdated information, inconsistent reasoning, or fabricated details.

  • Verify material facts against current primary sources before relying on them.
  • Check prices, corporate actions, earnings dates, filings, and order details independently.
  • Treat alerts and monitoring receipts as software signals, not guarantees that every event was detected.
  • Do not enter passwords, government identifiers, bank credentials, or other unnecessary sensitive information into prompts or notes.

Accounts and access

You must provide accurate account information and keep your sign-in method secure. You are responsible for activity under your account and for promptly notifying us if you suspect unauthorized access. You may not share, sell, transfer, or provide automated access to your account unless we expressly allow it.

Access may be limited by invitation, plan, usage allowance, geography, system capacity, or product eligibility. We may refuse registration or restrict features where reasonably necessary to protect the Service, users, or third parties.

Plans, credits, and billing

Some features require a paid subscription, prepaid usage credits, or a separate top-up. Prices, included usage, renewal periods, and plan limits are shown at checkout or in the Service and may differ by plan. Payments are processed by our payment provider; we do not receive or store your full payment-card number.

Unless the checkout terms say otherwise, subscriptions renew for the stated billing period until canceled. Cancellation stops future renewal but does not retroactively refund a completed billing period. Usage credits may expire, be plan-specific, and have no cash value. Refunds are provided only where stated at purchase or required by applicable law.

We may change future pricing or plan features with reasonable notice. Taxes and charges imposed by your payment provider are your responsibility.

Your content and portfolio data

You retain ownership of portfolio records, theses, notes, plans, prompts, uploaded materials, and other content you submit (“Your Content”). You grant us a limited, non-exclusive license to host, copy, process, transmit, and display Your Content only as needed to operate, secure, support, and improve the Service.

You represent that you have the right to provide Your Content and that doing so does not violate law or another person’s rights. You are responsible for maintaining any independent records you need; the Service is not a system of record for brokerage, tax, regulatory, or accounting purposes.

Bring-your-own API keys

If you connect your own third-party API key, you authorize the Service to use that credential to make requests you initiate or enable. You are responsible for the provider account, its terms, spending limits, charges, quotas, and credential security.

We encrypt stored API keys, but no system can guarantee absolute security. Use restricted keys where supported, monitor usage with the provider, remove keys you no longer need, and contact us immediately if you believe a credential was exposed.

Acceptable use

You may not misuse the Service. In particular, you may not:

  • break the law, infringe rights, deceive others, manipulate markets, or facilitate unlawful trading;
  • probe, bypass, disable, or interfere with security, access controls, plan limits, metering, or infrastructure;
  • introduce malware, scrape the Service at scale, overload systems, or access another user’s data;
  • resell, sublicense, mirror, or commercially exploit the Service without written permission;
  • reverse engineer the Service except where applicable law expressly permits it; or
  • use Service output to build or train a competing model or product without written permission.

MackAI property and feedback

The Service—including its software, interface, visual design, workflows, documentation, scoring systems, compilations, and branding—is owned by us or our licensors and protected by applicable intellectual-property laws. These Terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service while your account is authorized.

If you send feedback or suggestions, you allow us to use them without restriction or compensation. This does not transfer ownership of Your Content.

Third-party services and sources

The Service depends on third-party authentication, hosting, payment, market-data, search, AI, email, and error-monitoring providers. Their products, data, links, and availability are outside our control and may be governed by separate terms. We are not responsible for a third party’s content, service interruption, policy, or conduct.

Source links and citations are provided for convenience. A citation does not mean we endorse the source or guarantee that an AI output accurately represents it.

Availability, changes, and termination

We may add, modify, suspend, or discontinue features, models, data sources, limits, or the Service itself. We do not guarantee continuous availability, delivery of every alert or email, compatibility with every device, or preservation of every beta feature.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk or harm, fail to pay amounts due, or where continued access is no longer commercially or legally practical. Where feasible, we will provide notice and a reasonable opportunity to export or request Your Content.

Disclaimers and liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability.

To the maximum extent permitted by law, MackAI and its operators, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, opportunities, or goodwill; investment or trading losses; or the cost of substitute services arising from or related to the Service.

To the maximum extent permitted by law, our aggregate liability for all claims arising from the Service will not exceed the greater of US$100 or the amount you paid to MackAI for the Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

Changes, general terms, and contact

We may update these Terms to reflect product, legal, security, or operational changes. If a change is material, we will provide reasonable notice through the Service, email, or another appropriate channel. The updated date above shows when the latest version was posted. Continued use after the effective date means you accept the revised Terms.

If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service. Applicable mandatory consumer protections are not limited by these Terms.
